Content of this Data Privacy Declaration

MAG machines GmbH („MAG“) cares about the protection of their customers, interested public, business partners and other visitors of their website. MAG thus observes the GDPR and all other relevant data protection rules when processing personal data.

This Data Protection Declaration describes how, by whom, when, how long and in which way personal data, which you provide to us via communication with us or via visiting our website, is being processed.

 

Scope

This data protection declaration is relevant only regarding MAG and their website www.mag.at. It is not relevant regarding other websites that are linked to ours.

 

Collection and procession of personal data

MAG processes personal data that was submitted to us, insofar, as these data is necessary to conduct and execute contracts or in order to cooperate, as well as for their own entrepreneurial purpose and in order to defend against claims. In case deemed necessary, MAG can also collect personal data from public registries (e.g. companies’ register, trade register).

The legal basis for this data procession is Article 6 Paragraph 1 litera f GDPR as well as other relevant data protection provisions in connection with the execution and fulfillment of contracts with their customers and business partners and in connection with MAG’s own entrepreneurial efforts.

MAG obligates and educates their employees that get into contact with personal data in order to comply with the relevant data protection provisions.

 

Newsletter

When you sing up for our newsletter, we forward the provided data to The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308 USA (www.mailchimp.com). This company has obliged to comply with the GDPR including the use of standard contractual clauses as well as to comply with all other relevant (European) data protection provisions.

Via our newsletter, we inform the recipients about recent developments regarding our products as well as about other general news regarding our company.

The deregistration from our newsletter is possible any time.

Website

When visiting our website, we register your IP-address, and your current position when you use the Google-Maps-function on our “contacts”-page. This data will not be attributed to a natural person. The registration is exclusively for statistical purposes, for optimizing our services and for increasement of the user-friendliness of our website.

We use the cookie “.pll_language” for technical reasons only, in order to save your language settings. This cookie does not store any personal data. Besides that, we do not use any other cookies, especially no analysis-cookies.

 

Transmission to other recipients

In order to fulfill and to handle our contractual relationship to you, furthermore following legal or official regulations, it might be necessary to transmit your personal data to third parties. Furthermore, MAG contracts data processing contractors. Personal data will not be transmitted to recipients outside the EU, except it is necessary for the abovementioned purposes (besides the newsletter, see above). MAG obliges its data processing contractors to comply with the GDPR and all other relevant data protection provisions.

 

Duration of storage

MAG stores personal data for the time of the contractual relationship and beyond that time only as long as it is necessary for the defense from claims or as long as it is mandatory following the law or official requirements.

 

Rights of persons concerned

Persons concerned, whose data is being processed by MAG, under the relevant legal requirements, are entitled to information on processing their data, to the rectification of false data, as well as to deletion of their data where appropriate. Such inquiries are to be made via e-mail to office@mag.at or via regular mail to the address mentioned in the imprint. In cases persons are of the opinion that MAG is processing their data unrightfully, they may complain to the Data Protection Authority (www.dsb.gv.at). 

 

Persons concerned may disagree to their data being processed.

In case MAG has obtained the permission to process data from persons concerned, this permission can be revoked anytime vie e-mail to the abovementioned address. A revocation does not affect the rightful data procession until the point of the revocation. In case the data procession was not only based on the permission, but also on one or more complementary legal bases (e.g. fulfillment of contract, legitimate interest), these complementary legal bases are not suspended by such revocation.

 

Personal Data is not processed for profiling purposes.

Providing personal data to MAG is not obligatory. However, the denial of providing personal data which is necessary in order to fulfil a contractual relationship may lead to not concluding a contract or to the rightful termination of a contract by MAG.

Third-party services – plugins, pixels, and social networks

Data processing in the course of the use of plugins, pixels, and social networks only takes place if you have given your consent (Art  6 para 1 lit a DSGVO), or – insofar as consent is not legally required – this is in our legitimate interest (optimization of our website and user experience, marketing of our company, incl. optimization of our marketing activities), unless your interests or fundamental rights and freedoms, which require the protection of personal data, prevail (Art 6 Abs 1 lit f DSGVO).

1.1. Facebook social plugin

1.1.1. Extent of data processing

On our website, we use social plugins from Facebook (e.g., the “Like”- button). We have implemented this social plugin with a two-click system, so that your browser only sends data to Facebook if you actively interact with Facebook’s social plugins (i.e., click on them). When you interact with Facebook’s social plugins, you thereby consent to the transmission of your data to Facebook.

According to Facebook, this data includes your IP-address, which website you have visited, the date, time and other information concerning your browser.

1.1.2. Purpose of data processing

Users of our website thereby have the opportunity to share content from our website within Facebook (through “LIKE” or “SHARE” options).

We also use the social plugins to provide you with a better user experience on our site and, on the other hand, because, as a result, Facebook can optimize our advertisements.

We would like to point out that Facebook may use this information for the purpose of advertising, market research and the design of Facebook pages according to needs. For this purpose, Facebook creates usage, interest, and relationship profiles, e.g., to evaluate your use of our website regarding the advertisements displayed to you on Facebook, to inform other Facebook users about your activities on our website and to provide other services associated with the use of Facebook.

Facebook Social Plugins belong to the social network Facebook, which is operated by Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”).

Within the context of this service, data transmission to the USA takes place or cannot be ruled out. Meta Platforms is certified under the EU-U.S. Data Privacy Framework; the data transfer is therefore based on the European Commission’s adequacy decision of July 10, 2023.

The settings are platform-independent, i.e., they are applied to all devices, such as desktop computers or mobile devices, according to our information.

1.2. FACEBOOK PIXEL

1.2.1. Extent of data processing

Your actions are saved in one or more cookies. These are only set with your consent. These cookies allow Facebook to match your user data (such as IP-address, user- ID) with your Facebook account data. The collected data is anonymous and not visible to us and can only be used in the context of advertisements. You can prevent the link with your Facebook account by logging out before you take any action.

1.2.2. Purpose of data processing

Data processing is carried out for the sake of analysis, optimization, and economic operation of our online offer.

With the help of Facebook Pixel, it is possible for Facebook, on the one hand, to determine the visitors to our website as a target group for the display of ads (so-called “Facebook-Ads”). Accordingly, we use Facebook-Pixel to display the Facebook-Ads placed by us only to those Facebook users who have also shown an interest in our online offer or who have certain characteristics (e.g., interests in certain topics or products determined on the basis of the websites visited) that we transmit to Facebook (so-called “Custom Audiences”). With the help of Facebook Pixel, we would also like to ensure that our Facebook-Ads correspond to the potential interest of users and do not have a disruptive effect. With the help of Facebook Pixel, we can, on the one hand, track the effectiveness of the Facebook ads for statistical and market research purposes by seeing whether users were redirected to our website after clicking on a Facebook ad (so-called “Conversion”).

1.3. Instagram Social Plugins

1.3.1. Extent of data processing

On our website, we use social plugins from Instagram. We have implemented this social plugin with a two-click system so that your browser only sends data to Facebook when you actively interact with the Instagram social plugins (i.e., click on them). When you interact with Instagram’s Social Plugins, you thereby consent to the transmission of your data to Facebook.

According to Facebook, this data includes your IP-address, which website you visited, the date, the time and other information concerning your browser.

If you are logged in to Instagram, Instagram can directly assign your visit to our website to your Instagram account. The information is also published on your Instagram account and displayed there to your contacts. If you do not want Instagram to assign the data collected via our website directly to your Instagram account, you must log out of Instagram.

1.3.2. Purpose of data processing

Our website users are thus offered the opportunity to share content from our website on Instagram i.e., our online presence is improved.

1.3.3. Transmission of the data

The Instagram Social Plugins service is offered by the social network Facebook, which is operated by Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”).

1.4. LinkedIn Insight Pixel/Tag

1.4.1. Extent of data processing

We use functionalities of the marketing plugin LinkedIn Insight Tag of LinkedIn Ireland, Unlimited Company, Wilton Place, Dublin 2, Ireland (“LinkedIn”). The plugin allows us to obtain information about visitors on the website and to run detailed campaign reports. We have implemented this social plugin with a two-click system so that your browser only sends data to LinkedIn when you actively interact with (i.e., click on) LinkedIn’s social plugins. If you interact with the social plugins of LinkedIn, you thereby consent to the transmission of your data to LinkedIn. In particular, the following personal data will be processed by LinkedIn as a result:

  • URL
  • Referrer URL
  • IP-address shortened or hashed
  • Device and browser properties and timestamp.

Cookies from LinkedIn are stored on your terminal device – only with your consent. You can find more information about the cookies used in LinkedIn’s privacy policy. LinkedIn does not share any personal data with us, but only provides aggregated reports about the target group and advertisements. LinkedIn also offers a remarketing function that allows us to show you targeted personalized advertisements outside of our website without revealing your identity. 1.4.2. Purpose of data processing

The LinkedIn Insight Tag is used to collect information about users of our website, in particular the targeted display of online advertisements, to contextualize and personalize the advertising network, especially if you are logged into an existing account of the service.

1.4.3. Data transfer

Within the context of this service, data is transferred to the USA i.e., such transfer cannot be ruled out. We would like to point out that, in the opinion of the European Court of Justice, there is currently no adequate level of data protection in the case of data transfer to the USA and that there are therefore various risks (such as possible access by US secret services).

As long as you are logged in to your LinkedIn account, it is possible for LinkedIn to associate your visit to our website with you and your user account. If you do not agree to this, you most log out of your LinkedIn account.

1.5. GOOGLE AD MANAGER

1.5.1. Extent of data processing

Data processing is carried out by means of a pseudonymous identification number, through which the service can recognize which advertisements have been displayed to you and which have been accessed. The data is used for the cross-website placement of advertisements. Google Ad Manager will only process your data if you have given your consent.

1.5.2. Purpose of data processing

For marketing, analysis, and optimization purposes of our online offer, we use the Google Marketing Platform / Google Ad Manager Service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”).

1.5.3. Transmission of the data

The information evaluation, this data is transferred by Google to a server in the USA and stored there. A transfer of data by Google to third parties only takes place due to legal regulations or in the context of order data processing.

1.6. GOOGLE TAG MANAGER

1.6.1. Extent of data processing

When the Google Tag Manager is launched, your browser establishes a connection to Google’s servers. Through this, Google obtains knowledge that our website was accessed via your IP address.

1.6.2. Purpose of data processing

With the help of the Tag Manager, website tags can be administered via an interface. This allows us to add tracking codes or conversion pixels to websites without interfering with the source code, whereby the data is only forwarded by the Tag Manager, but not collected and stored. The Tag Manager itself does not process any personal data.

1.6.3. Transmission of the data

The provider of the Google Tag Manager service is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”).

1.6.4. Storage period

Your personal information will be stored for as long as necessary to fulfil the purposes described in this Privacy Policy or as required by law. According to Google, advertising data is anonymized in server logs by Google deleting parts of the IP address and cookie information after 9 and 18 months, respectively.

In order to prevent this service, you can – in addition to not giving your consent – also install a JavaScript blocker. However, this may lead to restrictions of the website.

1.7. GOOGLE ANALYTICS

1.7.1. Extent of data processing

We use Google Analytics only with your consent.

The data processing of the information by Google is carried out for the purpose of data evaluation and reporting on user activities on our website and we use Google Analytics only with IP anonymization enabled, so that all data is collected anonymously. Only in exceptional cases is the full IP address transmitted to a Google server and shortened there.

During the website visit, the following data is collected, among others:

  • the pages you visit
  • Achievement of “website goals” (conversions, e.g., newsletter sign-ups, downloads, purchases)
  • your user behaviour (for example clicks, dwell time, bounce rates)
  • your approximate location (region)
  • your IP address (in shortened form)
  • technical information about your browser and the terminal devices you use (e.g., language setting, screen resolution)
  • your Internet service provider
  • the referrer URL (via which website / via which advertising medium you came to our website)

1.7.2. Purpose of data processing

For the sake of statistics and analysis of user behaviour, as well as to optimize our website, we use the functions of the web analytics service Google Analytics. The provider of this service is Google Ireland Limited, Barrow Street, Dublin 4, Ireland (“Google”). Google Analytics uses cookies that enable an analysis of the use of our website.

1.7.3. Transmission of the data

Information about the use of the website, in particular browser type/version, operating system, the previously visited page, host name of the accessing computer (IP address), time of the server request are usually transmitted to a Google server and stored there.

1.7.4. Storage period

The data about the use of our website will be deleted immediately after the end of the storage period set by us in each case. Google Analytics gives us the following options for the storage period: 14 months, 26 months, 38 months, 50 months, do not delete automatically. You can ask us at any time for the storage period currently set by us.

1.7.5. Revocation

You can revoke your consent at any time with effect for the future.
